Jacques Tours and Transers and Lightkeeper’s Legacy Tours

Preamble

Our philosophy is simple: we want to host you with the warmth, care, and personal attention you would offer a friend visiting your home. While we maintain professional standards—operating fully insured, roadworthy vehicles and prioritizing your safety—we believe true hospitality should feel effortless and personal. Please review our operating terms below, which govern all services provided by Jacques Tours and Transfers (Pty) Ltd (trading as Lightkeeper’s Legacy).

  1. Service Level Agreement
  • Standard of Care: We commit to delivering high-touch, professional private touring services. All vehicles are clean, roadworthy, fully licensed, and insured for passenger liability.
  • Communication: You can reach us by email at info@lightkeeperslegacy.co.za or info@jacquestoursandtransfers.co.za. We aim to respond to all inquiries within 24 to 36 hours.
  • Inclusions: Transport, guided commentary, and specific entries or refreshments are included only when explicitly stated in your itinerary or quotation. All personal expenses are the client’s responsibility. Unless specifically stated, park entry fees, such as Boulders Penguin Colony and the Cape Peninsula National Park, are not included in the price due to variable entry fees and prices.
  1. Bookings, Quotations and Payments
  • Validity: Quotations are valid for 48 hours from the issue date. Dates are held provisionally and remain subject to availability until a deposit is secured.
  • Deposit Requirement: A 50% deposit is required within 2 days of the invoice date to confirm your booking. The remaining 50% balance is due no later than 7 days before tour commencement.
  • Late Bookings: For bookings made within 7 days of the tour date, the full amount is payable immediately upon confirmation.
  • Currency and Bank Charges: All transactions must be made in South African Rand (ZAR) via the agreed payment method. Clients are responsible for any international wire fees or bank deposit charges so that the full invoiced amount reaches our account.
  1. Cancellation and Refund Policy
  • Client Cancellations: Cancellations must be submitted in writing via email to info@lightkeeperslegacy.co.za and are effective from the date received. The following cancellation fees apply:
    • 30 days or more before tour date: Full refund of the deposit.
    • Between 7 and 29 days before tour date: 50% refund of the deposit.
    • 6 days or less before tour date / No-show: 100% forfeiture of the total tour fee.
  • Refund Processing: Approved refunds will be returned via the original payment method within 14 business days.
  • Cancellations by Us (Force Majeure): If we must cancel a tour due to extreme weather, safety risks, road closures, or uncontrollable events, you may choose to reschedule (subject to availability) or receive a full refund minus any non-refundable third-party costs already incurred (e.g., prepaid permits). We are not liable for external travel costs like flights or accommodation.
  1. Itinerary Flexibility and Availability
  • Unforeseen Changes: Routes, venues, and schedules may occasionally need adjustment due to traffic, weather, or operational closures. We reserve the right to make necessary modifications provided they maintain the overall quality and integrity of the experience.
  • Minimum Numbers: Private tours are priced according to agreed-upon minimum passenger tiers or vehicle charters.
  1. Responsibility and Liability
  • Participation Risk: Participation in our tours is undertaken at your own risk. We maintain appropriate passenger liability insurance, but neither Jacques Tours and Transfers (Pty) Ltd, its directors, nor its drivers will be held liable for any loss, injury, or damage to persons or property unless caused by gross negligence or wilful misconduct.
  • Statutory Rights: Nothing in these terms attempts to limit consumer rights under the Consumer Protection Act (CPA) or South African law where applicable.
  1. Children and Minors
  • Supervision: Minors under 18 years must be accompanied by a parent or legal guardian at all times.
  • Suitability: The accompanying adult is responsible for ensuring that tour activities match the physical and age requirements of any minors in their care.
  1. Personal Information and Privacy (POPIA)
  • Data Protection: We collect and process personal details (such as names, contact numbers, and email addresses) strictly to fulfil your booking and communicate travel details, in compliance with the Protection of Personal Information Act (POPIA).
  • Confidentiality: We do not sell or share your personal data with third parties except where necessary to deliver your tour components or comply with legal obligations.

  • Jurisdiction: These terms are governed exclusively by the laws of the Republic of South Africa, and any legal proceedings shall be subject to the jurisdiction of South African courts.
